WHAT ARE CITATIONS TO DISCOVER ASSETS?
Citations to Discover Assets is a formal procedure where a person has a judgment and wants to turn the judgment into cash. A Citation to Discover Assets is a legal procedure, which enables judgment holders to receive information on the collectability of a Defendant(s). Simply put, a Citation to Discover Assets is where a debtor or Defendant has been served with legal paperwork to appear at the Circuit Court of the 23rd Judicial Circuit (Kendall County Circuit Court) at 807 West John Street, Yorkville, Illinois 60560.
TYPES OF CITIATIONS
There are generally two (2) types of major Citations to Discover Assets:
1. Third-Party Citation to Discover Assets
A Third-Party Citation to Discover Assets is a court procedure issued to a financial institution such as your bank. Generally, upon receiving the Citation to Discover Assets, the Bank must freeze your account and assets. The freezing of your account jeopardizes the debtor’s ability to secure their assets and personal property.
Most debtors have a wild card exemption, which exempts the first $4,000 in assets. The debtor can file a motion or hire an attorney to file a motion and secure the release of their bank account. The bank will not unfreeze your account until there is a court order addressing the matter. With a Citation to Discovery Assets, your financial institution must inform the judgment creditor the amount of accounts and assets at their financial institution under your control.
2. Personal Citation to Discover Assets
A Personal Citation to Discover Assets is a court procedure where the judgment creditor wants to have a deposition of the debtor or debtors. The purpose of the deposition is to identify any exempts, which are not exempt to collection such as a wage garnishment or real estate property. The Judgment gives the creditor the legal right to levy your bank account or garnish your wages including the right to depose you under oath.
