The Channahon and Will County Eviction Process is governed by the Forcible Entry and Detainer Act, 735 ILCS 5/9-101. The Forcible Entry and Detainer Act regulates landlords and tenants and are the laws that apply for the landlord and eviction process in Joliet and Will County.
There are three (3) types of landlord notices, which are the most common notices in Will County Evictions. These 3 notices are the 5-day, 10 day and 30-day notices. Here is a summary of the different type of eviction notices.
- 5-day notice is a notice for non-payment of rent. This is essentially a notice which warns the tenants that if they do not pay within 5 days from receipt of the 5-day notice, the Landlord has the right to terminate the rental lease agreement.
- 10-day notice is a type of notice, which governs breach of the lease such as property damage or pets. The tenants have 10 days to move out or the landlord may begin the eviction process.
- The 30-day notice is a written eviction notice, which terminates the oral month to month lease or terminates the hold over rental agreement. Thus, a lot of tenants have an expired lease and they remain in the property without a new lease. This is called a “holdover tenant”.
